1. Parties and Acceptance
These Terms of Service ("Terms") are entered into by and between Pocket Studios ("Pocket Studios", "we", "us", "our") and the merchant business entity or person registering for and using Mashroo3 ("Merchant", "you").
By creating an account, accessing, or using Mashroo3, you confirm that you have read, understood, and agreed to these Terms and related policies referenced in these Terms.
2. Service Scope
Mashroo3 is a software-as-a-service platform for order, inventory, customer, payment, and delivery workflow operations. Pocket Studios provides software functionality and does not act as a courier, payment institution, marketplace seller, or telecom provider.
3. Limitation of Liability (Wakilni Integration)
Mashroo3 may integrate with third-party providers, including Wakilni. Pocket Studios is a software interface provider only. Pocket Studios is not liable for third-party delivery outcomes, including but not limited to lost packages, damaged items, delayed delivery, failed delivery attempts, or third-party operational errors.
Merchant agrees that claims relating to shipping execution are solely between Merchant and the relevant delivery provider. To the maximum extent permitted by law, Pocket Studios is not responsible for inventory loss, replacement cost, lost profit, or consequential damage arising from third-party delivery incidents.
4. Service Availability and Disclaimer
Mashroo3 is provided on an "as is" and "as available" basis. Pocket Studios does not guarantee uninterrupted, error-free, or always-available service.
Temporary downtime, maintenance windows, infrastructure incidents, or provider outages may affect availability. To the maximum extent permitted by law, Pocket Studios is not liable for revenue loss, missed orders, business interruption, or indirect damages resulting from service interruptions or degraded performance.
5. Merchant Responsibilities
- Provide accurate account information and maintain account security.
- Use Mashroo3 in compliance with applicable laws and platform policies.
- Ensure all products, services, and communications with customers comply with legal and regulatory requirements.
6. Third-Party Services
Mashroo3 relies on third-party services such as hosting, messaging, and delivery partners. Use of those services may be subject to separate third-party terms and policies, which you are responsible for reviewing and complying with.
7. Fees, Billing, and Cancellation Reference
Subscription and billing behavior is governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference.
8. Suspension and Termination
Pocket Studios may suspend or terminate access where required to protect platform integrity, legal compliance, or third-party integrations, including cases of policy abuse or unlawful activity.
9. Limitation of Damages
To the fullest extent permitted by applicable law, Pocket Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Lebanon. Any dispute, claim, or controversy arising out of or related to Mashroo3 or these Terms shall be subject to the exclusive jurisdiction of the competent courts of Beirut, Lebanon.
